SPANISH AND LATIN AMERICAN DESK

ArbLit’s Spanish and Latin American desk is the first group of lawyers in Italy with a specific knowledge of the Hispanic market and devoted to handling complex arbitrations, both commercial and investor-State, in Spanish.

 

The desk, led by Luca Radicati di Brozolo, assists both Italian and foreign clients in disputes linked to Spain and Latin America. We also act as co-counsel of Spanish and Latin American law firms, including in cases where Italian law applies or when our specialized knowledge of transnational litigation and business transactions is needed.

The members of our desk also act as arbitrators, secretaries and assistants to arbitral tribunals.

OUR MOST RECENT CASES HANDLED BY THE DESK

Our Spanish and Latin American desk’s most recent experience in commercial and investor-State arbitrations includes the following:

  • Representing two leading Italian construction companies in a Panama-seated ICC arbitration brought by a Latin American company in a dispute relating to a hydroelectric project (amount in dispute EUR 70 million).
  • Representing an Argentine company in a Buenos Aires-seated ICC arbitration relating to the supply of machinery (amount in dispute EUR 12 million).
  • Luca Radicati acted as president of the arbitral tribunal and Emilio Bettoni as assistant to the tribunal in an ICSID arbitration between a Mexican telecommunications company and the Republic of Colombia (ICSID Case No. ARB(AF)/16/5, América Móvil S.A.B. de C.V. v. Republic of Colombia)
  • Luca Radicati acts as president of the Annulment Committee of an ICSID award issued against Venezuela, whereas Emilio Bettoni as assistant to the Committee (ICSID Case No. ARB/13/11 – Annulment Proceeding, Valores Mundiales, S.L. and Consorcio Andino S.L. v. Bolivarian Republic of Venezuela)
  • Luca Radicati acts as president of the arbitral tribunal and Lucia Pontremoli as secretary to the tribunal in a ICC arbitration between an international mining group and a Latin American State relating to the tax treatment of a mining project.
  • Luca Radicati acts as president of the arbitral tribunal and Emilio Bettoni as secretary to the tribunal in an ICC arbitration relating to a highway concession in Paraguay
  • Luca Radicati acts as president of the arbitral tribunal and Emilio Bettoni as secretary to the tribunal in an ICC arbitration relating to a refinery in Peru (approximate amount USD 250 million).
  • Luca Radicati acts as president of the arbitral tribunal and Francisco Trebucq as secretary to the tribunal in an ICC arbitration relating to a mining joint venture in Bolivia (approximate amount USD 90 million)
  • Luca Radicati acted as president of the arbitral tribunal and Emilio Bettoni as assistant to the tribunal in an arbitration under the rules of the Chambre Arbitrale Internationale de Paris relating to a highway concession in Peru (approximate amount EUR 50 million)
  • Luca Radicati acted as president of the arbitral tribunal and Emilio Bettoni as secretary to the tribunal in an arbitration administered by the Corte de Arbitraje de Madrid in a dispute between highway concessionaries in a European country (approximate value EUR 200 million; settled)
  • Luca Radicati acted as President of the arbitral tribunal and Francisco Trebucq as secretary to the tribunal in an UNCITRAL arbitration arising from a refinery project in Ecuador
